How to find Delaware Certificate of Public Review filings
Where the Health Resources Board publishes Certificate of Public Review records, what each document contains, and how to get the ones that are not online.
Where does Delaware publish Certificate of Public Review filings?
Delaware's program is the Certificate of Public Review, under 16 Del. C. Chapter 93. The Delaware Health Care Commission staffs the Health Resources Board, and its HRB page posts the monthly activity reports from 2020 on, current applicant presentations, notices of filed intent and the Application Decisions table. Board and review committee minutes, agendas and hearing transcripts are on the state's public meetings calendar, publicmeetings.delaware.gov.
What does each document tell you?
The monthly activity report lists notices of intent, applications received or withdrawn, applications deemed complete, public notices, public hearings and decisions, each with the applicant, project, estimated cost, place and date. The Application Decisions table gives the applicant, project, amount, year and result. An applicant presentation gives project details, owners and partners. The minutes record the committee recommendation, the Board vote, conditions, opposition and who spoke at a hearing.
Why is it hard to follow a request from start to finish?
Delaware prints no application numbers, so a project has to be followed by name across months of reports. The live page has no reports before 2020. The Application Decisions table leaves out four 2025 approvals and gives a different amount from the reports on 11 projects. Costs often change between the notice of intent, the application and the decision, and some monthly reports and minutes were never posted.
How do I get records that are not online?
The HRB page says "For years prior to 2020, please reach out to the HRB." Write to the HRB at the Delaware Health Care Commission, 1901 North Dupont Highway, New Castle. Ask by applicant and project, since there are no application numbers. Written Board orders and missing minutes have to be requested this way.
Is there other public data that helps?
The 2020 sunset review of the HRB explains the appeal and reconsideration process and the reasons for the 2019 Beebe denial. House Bill 17, signed May 12, 2026, repeals the certificate requirement for major medical equipment unless the capital expenditure threshold is met. The HRB also posts annual nursing home and assisted living utilization reports.
Where does COPN Atlas fit?
COPN Atlas joins the reports, the table and the minutes into one row per application: 81 Delaware applications, 78 filed from January 2016 through September 2026 and 3 filed in 2015 and decided in 2016. 71 were approved, 2 denied and 1 withdrawn; 5 are pending and 2 have no decision found. Each row shows the cost at every step, the Board vote and any opposition, with links to the reports and minutes. The file adds 16 notices of intent with no application in any report read.
